Definitions
References in these terms and conditions to ‘you’ and ‘your’ shall mean the person who makes a booking with us to attend one of our courses run at or from Willen Lake. Where the person participating in the course is not the person making the booking then references to ‘you’ and ‘your’ shall also include the participant where the context permits this.
References in these terms and conditions to ‘we’, ‘us’, ‘our’ and Whitecap Leisure Limited ‘means Whitecap Leisure Limited (company number 03979736) whose registered office is at Campbell Park Pavilion, Silbury Boulevard, Milton Keynes, Buckinghamshire MK9 4AD.
These terms and conditions apply to bookings made through our website and for bookings made via telephone or in person which are not considered ‘school or group’ bookings. If you are a ‘school’ or ‘group’ wishing to make a booking, our ‘Schools and Groups Booking Terms and Conditions’ will apply. A copy of the ‘Schools and Groups Booking Terms and Conditions’ are available upon request.
The expression ‘school’ includes any educational establishment of whatever type including universities, colleges, and private educational establishments. A ‘group’ is generally any booking made for 5 or more participants.

You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
- Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any services or information available through this website meet your specific requirements.

Price and Payment
All activities must be paid in full at the time of booking. Any due discount will be applied at the time of booking.
Cancellation, Failure to Attend and Exclusion
Whilst we try to ensure that all activities proceed on the date specified, there may be occasions, beyond our control when this will not be possible, and we reserve the right to cancel an activity in those circumstances. Examples of such circumstances are as follows:-
- A course instructor is unavailable for reasons of sickness or otherwise;
- Viable participant numbers are not achieved for that activity or date;
- Circumstances arise that are outside of our control, e.g. adverse weather, floods, fire, acts of God etc.
In such circumstances, you will be notified as soon as reasonably practicable, and an alternative date will be offered to you. If there are no alternatives dates convenient for you, we shall refund the amount you have paid for that course in full. We will not be liable for any other expenditure or costs incurred by you in the event of such cancellation and you are advised to take out your own cancellation insurance to cover such eventuality.
You may cancel your attendance on an activity by notifying us by email to the following email address: enquiries@willenlake.org.uk
If you notify us that you would like to cancel your attendance 24 hours or more prior to the activity start time you can choose to either: receive a refund for your booked activity; or rebook for a new date. If you choose to receive a refund, this will be subject to a 10% cancellation fee. If you choose to rebook, the credit will be applied to your online account and must be rebooked by you within 6 months of the original activity date. Rebooked sessions cannot be refunded.
If you notify us that you would like to cancel your attendance less than 24 hours prior to the activity start time, or fail to attend the activity, then you will not be entitled to either a refund or rebook for a new date.
Where an activity is scheduled to take place over two or more sessions then for the purposes of the preceding paragraph the start time of that activity shall be construed as the time on which the first session is scheduled to commence.
Should you fail to attend any session of an activity which takes place over two or more sessions, then you shall not be permitted to attend the remaining sessions unless we, in our discretion, otherwise agree. If we do permit you to attend subsequent sessions you will not be entitled to any refund for the missed session.
Any person who is excluded from an activity for any reason shall not be entitled to a refund.
Gift vouchers have no cash value and are non-refundable at any point.
Willen Wonders Card
The ‘Willen Wonders Card’ product is non-refundable and non-transferable. The ‘Willen Wonders Card’ may only be used by those cardholders named at purchase. Cardholders must upload a photo in their online account before first use for the card to be valid. We reserve the right to cancel your card if anyone other than the named cardholder uses or attempts to use your card. We reserve the right to change the range and value of benefits at any time. The purchase of a ‘Willen Wonders Card’ does not guarantee spaces on any activity and our normal cancellation policy applies to all pre-booked activities.
Medical Declaration and Waivers
All participants must be physically fit and capable of participating in the activity being booked. Should you have any concerns whether you are capable of participating in the activity then we advise you to speak to a member of our team who can explain what the activity will involve. If you still have any concerns whether you are capable of participating in the activity you should check with your doctor before booking.
Prior to attending the activity (or the first session of the activity where it involves two or more sessions) you will be required to complete an online waiver form, requiring you to disclose all known disabilities, physical impairments or medication that you are currently taking. Parents or guardians of participants who are under 18 years of age will be required to complete the waiver form on behalf of the participant. A link to complete this form is sent out with the booking confirmation and is also available on our website. Failure to complete this form prior to the start of the activity will result in you (or the participant concerned) being refused admission to the activity.
We reserve the right to refuse any booking on medical grounds if we consider it to be detrimental to the safety and smooth running of the activity or the safety of the other participants on the activity.
We also reserve the right at any time (including after a activity has started) to exclude a participant from a course where in our opinion that person is unable to safely take part in that course (whether for behavioural reasons, medical reasons or because of any disability or physical impairment or weakness).
Participants under 16
Participants under the age of 16 taking part in unaccompanied activities are required to be signed in and out by their parent/guardian at the start and end of each activity session. Persons making their way to and from the Watersports Centre alone need a note from their parent/guardian that they give permission for the child to leave the centre unsupervised.
Safety
Participating in any outdoor and adventurous activities carries an inherent risk of injury and, in the case of water-based activities, drowning. To minimise such risks, you must comply with all safety regulations and instructions. We reserve the right to exclude participants from any course if they appear intoxicated or engage in inappropriate behaviour or if they fail to follow any safety regulations and instructions that our staff may give.
Equipment
All equipment required to participate in a course will be provided by us. This includes suitable buoyancy aids for water-based activities. Participants owning their own equipment are welcome to use such equipment, subject to the suitability of the equipment and subject to holding appropriate third-party insurance; we reserve the right to require you to use our equipment where we deem your equipment to be unsafe or unsuitable.
Participants in water-based activities should bring a complete change of clothes, swimwear, a towel, and shoes they’re happy to get wet.
Photographs
We may require photographs and videos to be taken of course participants for marketing and training purposes. Participants (or their parents/legal guardians if the participant is less than 18 years of age) agree to photos and video being taken for these purposes.
Data Protection
We take the privacy of personal data that we may collect from or about you very seriously. Please refer to our privacy policy for important information on how we handle your data: www.willenlake.org.uk/privacy.
Right to Alter
We reserve the right to alter these conditions at any time by giving you prior written notice.
International Transfers
Data centre locations. We/Willen lake, etc. may transfer and process Customer Data anywhere in the world where we maintain data processing operations. We shall at all times ensure we provide an adequate level of protection for the Customer Data processed, in accordance with the requirements of Data Protection Laws.
Privacy Shield. To the extent that we process any Customer Data protected by the General Data Protection Regulations in a country that has not been designated by the European Commission or Swiss Federal Data Protection Authority (as applicable) as providing an adequate level of protection for Personal Data, will provide adequate protection (within the meaning of GDPR) for any such Customer Data by working with Data processors who have self-certified its compliance with Privacy Shield principles.
EXCLUSION OF LIABILITY
By booking attendance on a course you are deemed to acknowledge and understand that Whitecap Leisure Limited and its staff and agents (including any independent coaches that Whitecap Leisure Limited may engage to deliver the course) accept no responsibility for any loss injury or damage suffered by any participant which results from taking part in that course except where this can be shown to result directly from the negligence of Whitecap Leisure Limited and its staff and agents.
